What Happens if I Get a DUI With Other People in the Car?

Posted on October 22, 2026 in DUI Defense

Vienna, VA DUI LawyerHaving passengers in the car when you are stopped for DUI can change the penalties you face and the evidence in your case. Much depends on who those passengers were and whether anyone got hurt. Police may also treat your passengers as witnesses.

If you were arrested for DUI with passengers in the car in 2026, a Winchester, VA DUI lawyer can look at how they affect your charge and what defenses may apply.

Are DUI Penalties Higher in Virginia When Someone Else Is in the Car?

Simply having other people in the car generally doesn’t increase penalties for DUIs, as long as those other passengers were adults (18 or older). If the other passengers were hurt in an accident in conjunction with a DUI, there will often be more serious consequences.

What if the Person in the Car Was a Child?

Virginia adds penalties when the driver is carrying a minor. Under Virginia Code Section 18.2-270, a DUI committed while transporting a passenger 17 or younger adds an additional fine of $500 to $1,000 to normal DUI penalties. It also has a mandatory minimum of five days in jail.

A first DUI is a Class 1 misdemeanor with a mandatory minimum fine of $250. A blood alcohol level of 0.15 to 0.20 adds another five mandatory days in jail, and a level above 0.20 adds 10 days. A first offense with a child in the car when the driver has a high BAC could mean at least 10 days behind bars. The law applies to any passenger 17 or younger, including a friend’s child or a teenager you’re giving a ride.

What Happens if a Passenger Is Hurt in a DUI Accident in Virginia?

An accident that seriously injures a passenger can lead to a felony charge under Virginia Code Section 18.2-51.4. A driver can be charged with a Class 6 felony if the prosecution can prove that intoxicated driving caused serious bodily injury and showed a reckless disregard for human life. Simply causing an accident while intoxicated is not enough.

If the serious injury leaves the person with a permanent and significant physical impairment, it can be a Class 4 felony. Injured passengers may also be able to bring a civil claim against the driver for medical bills and other losses.

Can Your Passengers Be Witnesses in a Virginia DUI Case?

Police often talk to passengers during a DUI stop. What they say about where you’d been, how much you drank, or how you were driving can end up in the police report. Prosecutors can later subpoena passengers to testify in court.

What a passenger says can help or hurt your defense, such as by stating how much you actually drank. They may also offer a reasonable explanation for something an officer interpreted as a sign of impairment. A lawyer may compare their statements with the officer’s report and any footage from the stop to help build a defense against DUI charges.

What Should You Do After a DUI Arrest With Passengers in the Car?

While the presence of passengers can have a big effect on your case, you shouldn’t try to coach your passengers about what to say, especially children. Changes in their stories can create new legal hurdles for your case.

Other steps you can take after a DUI stop involving passengers include:

  • Writing down the names and phone numbers of everyone in the car
  • Making notes about where you were, what you drank, and when
  • Avoiding talking about the arrest on jail phone calls, which are often recorded
  • Avoiding posting about the incident or the hours before it on social media

When you are stopped, you have the right not to answer police questions about your drinking. You can politely decline and ask to speak with a lawyer first.
